Alooba Affiliate Program Terms and Conditions

1. Introduction

Welcome to the Alooba Affiliate Program ("Program"). These Terms and Conditions ("Terms") govern your participation as an affiliate ("Affiliate") in the Program operated by Alooba Pty Ltd ("Alooba," "we," "us," or "our"). By applying for or participating in the Program, you agree to comply with these Terms.

2. Definitions

  • Affiliate Code: A unique code assigned to each Affiliate for tracking referrals.
  • Referral: A new customer who uses an Affiliate's code and meets the qualifying requirements.
  • Bonus: The monetary reward earned by the Affiliate for successful referrals.
  • Recruitment Service: Alooba's service involving the sourcing and placement of candidates for clients.

3. Affiliate Eligibility and Application

  • Invitation-Based Participation: Participation is primarily by invitation extended to individuals we know or meet through networking, including current customers and podcast guests.
  • Application Process: Others may express interest via the affiliate page on our website. All applications are subject to manual review and approval by Alooba.
  • Eligibility Criteria: Affiliates must be at least 18 years old and comply with all applicable laws and regulations.

4. Affiliate Responsibilities

  • Accurate Information: Affiliates must provide accurate and complete information during the application process and update it as necessary.
  • Compliance: Affiliates must comply with these Terms and all applicable laws, regulations, and guidelines.
  • Promotion Ethics: Affiliates should act in good faith to refer genuine prospects who fit our ideal customer profile.

5. Affiliate Codes and Referrals

  • Unique Codes: Each Affiliate receives a personal code, which grants referred customers one month of free access to Alooba's product.
  • Usage Limit: Codes are initially capped at 10 uses to encourage thoughtful sharing and prevent mass distribution.
  • Code Expiration: Codes expire three (3) months after issuance. Affiliates may request extensions subject to Alooba's approval.
  • Referral Process:
    • Private Sharing: Affiliates are encouraged to share their codes privately.
    • Sign-Up Tracking: Referred customers must enter the Affiliate Code after signing up on the subscriptions page to start their free access.

6. Affiliate Bonuses and Payments

6.1 Subscription Referrals

  • Qualifying Requirements:

    • The referral uses a valid Affiliate Code that has not expired or reached its usage limit.
    • The referral starts a paid subscription at the end of the free period or within 3 months after it ends.

  • Bonus Amounts:

    • Lite Plan: Earn USD $200 per referral.
    • Professional Plan: Earn USD $500 per referral.
    • Enterprise Plan: Earn USD $1,000 per referral.

6.2 Recruitment Service Referrals

  • Qualifying Requirements:
    • The referred customer informs Alooba of the Affiliate's referral upon engagement.
    • The referred customer is not an existing or previous customer.
    • The referred customer engages Alooba for Recruitment Services.
    • The referred customer hires a candidate presented by Alooba and completes payment for the service.
  • Bonus Amount: Earn USD $2,000 per successful referral.
  • No Referral Limit: There is no limit to the number of companies an Affiliate can refer for Recruitment Services.

6.3 Payment Details

  • Payment Schedule: Bonuses are paid within thirty (30) days after Alooba receives payment from the referred customer.
  • Payment Methods: Payments are made via international bank wire transfer or PayPal.
  • Currency: All payments are made in United States Dollars (USD).
  • Tax Responsibility: Affiliates are responsible for any taxes due on Bonus payments received.

7. Code Usage and Extensions

  • Requesting Increases: Affiliates demonstrating quality referrals may request an increase in their code usage cap.
  • Evaluation: Alooba will review the Affiliate's previous referrals before approving additional uses or extensions.

8. Promotion Guidelines

  • No Mass Distribution: Affiliates must not share their codes publicly on social media, forums, or any mass distribution channels.
  • Prohibited Practices: Spamming, unethical marketing, or any activity that harms Alooba's reputation is strictly prohibited.

9. Termination

  • Termination by Affiliate: Affiliates may terminate their participation at any time by notifying Alooba in writing.
  • Termination by Alooba: We reserve the right to terminate any Affiliate's participation for violation of these Terms or any applicable law.
  • Effect of Termination: Upon termination, all rights granted under these Terms will cease immediately, and the Affiliate must cease using and distributing the Affiliate Code.

10. Limitation of Liability

To the maximum extent permitted by law, Alooba shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to this Program.

11. Modification of Terms

Alooba reserves the right to modify these Terms at any time. Affiliates will be notified of significant changes. Continued participation in the Program constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.

13. Acceptance of Terms

By participating in the Alooba Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
